Mediomix Diagnosis and Bioresearch Private Limited, a company incorporated under the provisions of the Companies Act, 2013, having its registered office at Rathi Legacy, Plot No.19/A, Ground Floor, B Side, Hoodi Main Road, Doddanekundi II Stage, Industrial Area, Bengaluru-560048. (hereinafter referred to as “We”, “Us”, or “Our”, which expression shall mean and include its affiliates, successors and assigns) is the proprietor of the website https://mediomixdb.com and the mobile application Mediomix App (the “Platforms”).

This privacy policy (“Privacy Policy”) constitutes a legal binding agreement between you (“You” or “Your”, “User”), as the user of the Platforms, and Us, as the owner and operator of the Platforms. This Privacy Policy is effective as of May 13, 2025. We reserve the right, in Our sole discretion, to terminate Your access to the Platforms and/or other mediums at any time, without notice to You, for general maintenance or for any reason whatsoever. We, at Our sole discretion, reserve the right to reject Your request, if any without assigning any reason thereof.

You are hereby advised to read this Privacy Policy carefully and fully understand the nature and purpose of gathering and/or collecting sensitive, personal and other information and the usage, disclosure and sharing of such information in Your use of the Platforms and or availing of services provided by Us. This Privacy Policy does not cover information You may choose to share with other users of the Platforms.

This Privacy Policy details how We handle and maintain the information collected when You visit Our Platforms and / or for the provision of services and / or pertaining to the products, if any, manufactured and sold by Us (collectively, the “Services”) to You. Use of Our services is governed by Our Terms of Use.

This Privacy Policy has been prepared under the provisions of the (Indian) Contract Act, 1872, (Indian) Information Technology Act, 2000 (“IT Act”) and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“IT Rules”) promulgated thereunder, and sets out the practices and policies for the protection of personal information (including sensitive personal data or information) collected, received, possessed, stored, dealt with or handled by Us.

Please read this Privacy Policy carefully before proceeding, by completing the registration process on the Platforms and/pr by use of the Platforms, you hereby signify your agreement and consent to this Privacy Policy. If you do not agree with the provisions of this Privacy Policy, then please do not access the Platforms and/or do not complete the registration process on the Platforms.

1. DEFINITIONS


1.1. “Data Protection Laws” shall mean the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

1.2. “Personal Information” shall mean any information that relates to You, which, either directly or indirectly, in combination with other information available or likely to be available with Us, is capable of identifying You and is not otherwise generally available in the public. For avoidance of doubt, examples of Personal Information include Your name, address, date of birth, voice, national identity number if any, driving license number, permanent account number.

1.3. “Sensitive Personal Information” shall mean Personal Information, which consists of information relating to any of the following:

 1.3.2. financial information such as bank account or credit card or debit card or other payment instrument details;
 1.3.3. sexual orientation;
 1.3.4. medical records and history;
 1.3.5. any details relating to the above clauses as provided to avail the Services.

1.4. “User Information” shall mean, collectively, Your Personal Information and Sensitive Personal Information or data or any other information collected from You.

2. APPLICABILITY


2.1. This Privacy Policy describes Our policies and procedures on the collection, use, storage and disclosure of any Personal Information or Sensitive Personal Information provided by You while using Our Platforms or availing our services. This Privacy Policy specifically governs the collection and use of Personal Information, Sensitive Personal Information, non-personal information or any other information provided by You and the processing of such information while using Our Platforms or while availing services.

2.2. The Privacy Policy together with the ‘Terms of Use’ are referred to as Our documents.

2.3. During the course of Your association with Us, You may be required to execute certain other consent forms and such consent forms and this Privacy Policy shall, together with the ‘Terms of Use’ unless explicitly specified to the contrary, govern Your relationship with Us.

In the event of any inconsistency or conflict between Our documents, any consent forms, or other agreements entered into with Us, the interpretation that most closely aligns with the original intent of the drafting party (Us) shall prevail. Where specific consent or agreements involve additional rights or obligations, such provisions may take precedence over general terms, provided they do not contravene applicable laws.

3. INFORMATION WE COLLECT


3.1. Information that You provide – We collect personally identifiable information about You which You affirmatively choose to submit to Us, including Personal Information and Sensitive Personal Information while subscribing to avail the services provided by Us or while accessing and/or registering on Our Platforms. With regard to creating an account and registering on the Platforms, We may process your name, phone number, e-mail address, age, date of birth, medical prescription, medical status, medical reports history, medication history, account information like user name, password and device information like preferences, time zone, uploaded images, location data, etc.

3.2. Web usage information – We may collect information such as the time and date of Your visit, Your location, internet service provider, operating system, device information, IP address, the pages and other content that You access, cookies, pixel tags and the number of times You return to the website/Platforms. This information is used in the aggregate for Our internal marketing and similar purposes. We may also integrate with the website/Platforms technology provided by third parties (e.g., Google Analytics) to accomplish this information collection. In addition, We may use a variety of other technologies that collect similar information for security and fraud detection purposes. We may also collect information from You during phone calls or video calls, or via e-mail correspondences with Our representative(s).

3.3. Payment Information – We do not collect, access, store, or process any payment-related data or financial information such as credit card, debit card, net-banking, mobile wallet, or UPI details (“Payment Information”). All payment transactions initiated through the Platforms are securely processed by independent third-party payment gateways, which are governed by their own privacy policies and terms of service. We merely facilitate the redirection of Users to such payment gateways and have no control over the transaction process, including payment verification, authentication, or confirmation. Accordingly, We shall not be liable for any loss, claim, damage, or unauthorized disclosure of Your Payment Information arising out of or in connection with the use of such third-party payment services. You acknowledge and agree that any Payment Information provided by You is directly submitted to the third-party payment service provider and not to Us. To the fullest extent permitted by applicable law, We disclaim all liability for any damages, losses, or claims arising from: (a) the intentional or unintentional disclosure of any information related to Your payment transaction; (b) any failure or malfunction of the payment gateway; or (c) any act or omission of the third-party service provider during the payment process.

3.4. Genetic or Biomarker Information – As part of the services offered by Us, We may collect and process personal data derived from biological samples provided by You, including but not limited to saliva (“Genetic or Biomarker Information”). This information may include genotypic, phenotypic, microbiome, or other biomarker-related data generated through laboratory analysis and diagnostic processes. Each biological sample is assigned a unique alphanumeric identifier (“UID”) prior to laboratory processing. This UID ensures that laboratory personnel and other non-authorised stakeholders cannot directly link the sample to Your identity. Access to personally identifiable Genetic or Biomarker Information is strictly restricted to authorised personnel. All other employees, contractors, researchers, or third parties involved in data processing, analytics, or reporting will only have access to de-identified and anonymised datasets that cannot reasonably be traced back to You.

3.5. By voluntarily providing Your biological samples and using Our services, You provide express, informed, and specific consent for the collection, analysis, processing, and retention of Your Genetic or Biomarker Information in accordance with this Privacy Policy. You understand and agree that such information may constitute Sensitive Personal Data under Applicable Law.

3.6. Self-Reported Information – Personal Information, including medical conditions, ethnicity or family history that You voluntarily share in surveys, contests, promotional events, feedbacks, forms or features while entering Our Platforms or while availing the Services.

4. USE OF DATA


4.1. We will only process User Information, in accordance with applicable law, for the following purposes:

 4.1.1. Responding to Your queries, requests and other communications.
 4.1.2. Providing the Services including Our Platforms and related features as well as providing other information services.
 4.1.3. Resolve disputes, troubleshoot problems and enforce Our agreements with You, including Our documents.
 4.1.4. Enabling suppliers and service providers to carry out certain functions on Our behalf in order to provide the Services such as logistics providers, postal mail and e-mail, removing repetitive information from customer lists, analysing data, providing marketing assistance, etc. These third party service providers shall have access to such data which are needed to perform their functions, but may not use it for other purposes. We do not sell, rent, share, or otherwise disclose User Information for commercial or other purposes.
 4.1.5. Diagnose problems with Our servers, software, to administer Our Platforms, to gather demographic information and to track visitors to Our Platforms.
 4.1.6. Sending You personalized marketing communications based on Your interests opted upon filling forms on Our Platforms. We may also contact You and deliver information targeted to Your interests, such as banner advertisements, notices, service offerings, communications, newsletters, SMS messages, etc., relevant to Your interests and use of the Platforms. By accepting to this Privacy Policy, You expressly agree to receive such information and communications. In case You do not wish to receive such information and communications, then We request You to kindly unsubscribe/opt out of the receipt of such information and communications or email us at support@mediomixdb.com.
 4.1.7. Serving advertising to Your devices in accordance with Our cookie terms mentioned under this Privacy Policy. You have the right to disable cookies as set out under this Privacy Policy.
 4.1.8. Complying with applicable law, including in response to a lawful request from a court or regulatory body.
 4.1.9. Aggregated or de-identified User Information for research, development and educational purposes.

5. DISCLOSURE OF DATA


5.1. De-identified Information: Where feasible, We may share aggregated or de-identified User Information that cannot reasonably be used to identify You for analytics, research, or business purposes. Such aggregated or de-identified User Information may be shared with selected clients, service providers and Our partners.

5.2. Affiliates & Subsidiaries: We may share Your information with Our affiliates, subsidiaries, or parent companies to provide and improve Our Services, ensure consistent User experiences, and for internal business operations.

5.3. Service Partners & Vendors: We engage trusted third-party service providers (e.g., partner labs, hosting, payment processing, analytics, customer support) to assist in operating Our Platforms and providing services. These partners are contractually bound to handle data securely and only for the purposes We specify.

5.4. To Provide our Services: We may use the User Information You provide to contact You from time to time for consultation requests made by You, for providing Our services, or for other promotional purposes.

5.5. Legal & Public Authorities: We may disclose User Information if required by law, regulation, legal process, or governmental request, including to comply with court orders, protect Our rights, or ensure the safety of users and the public.

6. YOUR RIGHTS


6.1. Access to User Information: You shall have the right, upon request, to access and review Your Information provided to Us. You may decline to submit Personal Information or Sensitive Personal Information through the Platforms, in which case You may not be allowed to access certain features / parts of the Platforms and/or services offered by Us. If You are a registered user, You may update or correct Your information at any time by logging in to Your account in the Platforms. Alternatively, if You believe that any of Your information held by Us is inaccurate, You may write to Us at support@mediomixdb.com. It is Your responsibility to ensure that any information You provide to Us remains true, accurate and updated.

6.2. Retention: The User Information collected by Us shall not be retained for longer than is required for the purpose for which the information may lawfully be used or is otherwise required under any other law for the time being in force.

6.3. Updating Your Information: If You wish to amend or update Your Personal Information or Sensitive Personal Information, You may do so by emailing support@mediomixdb.com with Your request. A representative of Our customer support team will be in touch regarding Your request.

6.4. Withdrawal of Consent: You may withdraw Your consent for the collection, use, or disclosure of User Information at any time, subject to legal or contractual restrictions. To do so, please contact Us at support@mediomixdb.com. Note that withdrawing consent may affect Your access to certain features or Services itself.

6.5. Deceased Users: In the event of the death of a User, the User’s nominee, legal heir, or next of kin may contact Us with appropriate documentation to request access or deletion of User Information. We may process such requests in accordance with Applicable Laws and Our internal verification procedures.

7. STORAGE AND SECURITY


7.1. We endeavour to securely store all information We gather within databases controlled by Us. However, We may store information in locations outside Our direct control (for instance, on servers or databases co-located with hosting providers).

7.2. Our databases are stored on servers secured behind a firewall; access to the servers is password-protected and is strictly limited. However, You agree and acknowledge that no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while We strive to use commercially acceptable means to protect Your information, We cannot guarantee its absolute security.

7.3. We use commercially reasonable safeguards to preserve the integrity and security of User Information against loss, theft, unauthorized access, disclosure, reproduction, use or amendment.

7.4. The information that We collect from You may be transferred to, and stored at, a destination inside or outside India. By submitting Your information on Our Platforms, You agree to this transfer, storing and/ or processing. We shall take such steps as We consider reasonably necessary to ensure that Your information is treated securely and in accordance with this Privacy Policy and the Data Protection Laws.

7.5. In using the Platforms, You accept the inherent security implications of data transmission over the internet and the world wide web cannot always be guaranteed as completely secure. Therefore, Your use of the Platforms will be at Your own risk.

We assume no liability for any disclosure of information due to errors in transmission, unauthorized third party access or other acts of third parties, or acts or omissions beyond Our reasonable control and You agree that You will not hold Us responsible for any breach of security in such scenarios.

7.7. In the event We become aware of any breach of the security of User Information, We endeavour to intimate You and take appropriate action to the best of Our ability to remedy such a breach.

8. CONFIDENTIALITY


8.1. As a registered user with an account and a password, You are responsible for keeping Your password confidential.

8.2. We will keep confidential and protect any and all information provided by You except where disclosure is required or permitted by law.

8.3. We provide access of User Information in aggregated form to employees, agents, advisors, consultants and other third parties mentioned under this Privacy Policy who We believe reasonably need to come into contact with that information to provide services to You or for any other purpose as mentioned under this Privacy Policy.

8.4. The restrictions set out herein shall not apply to disclosure of User Information if and to the extent the disclosure is:

  (i) required by the applicable law of any jurisdiction,

  (ii) required by any applicable securities exchange, supervisory or regulatory or governmental body to which the relevant party is subject or submits, wherever situated, whether or not the requirement for disclosure has the force of law.

9. RESTRICTIVE COVENANTS


9.1. As mandated under Regulation 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, We hereby inform and caution You that You are strictly prohibited from using the Platform to host, display, upload, modify, publish, transmit, update, or share any information or content that:

  9.1.1. Belongs to another person and to which You do not have any legal right;
  9.1.2. Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, racially or ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever;
  9.1.3. Harms minors in any way;
  9.1.4. Infringes any patent, trademark, copyright, or other proprietary rights; Violates any applicable law for the time being in force;
  9.1.5. Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature; Impersonates another person or falsely associates You with another individual or entity;
  9.1.6. Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource;
  9.1.7. Threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting to any other nation;
  9.1.8. Promotes cigarettes, tobacco products, intoxicants including alcohol, or electronic nicotine delivery systems (ENDS), except as specifically permitted under applicable laws, including the Drugs and Cosmetics Act, 1940 and rules made thereunder;
  9.1.9. Threatens public health or safety, or the security of critical information infrastructure.

9.2. You may only use Our Platforms for legitimate purposes and not for any inter-alia fraudulent or speculative reservations.

9.3. You are restrained from altering, duplicating, distributing, transmitting, reproducing, publishing, licensing or selling any information, products or services acquired from Us through any means.

9.4. We may provide You access to photographs, graphics, video or other material which may be protected by intellectual property laws. You shall not copy, modify, transmit or create derivative works of such material. You also agree to not copy, modify, transmit or create derivative works of any of the intellectual property registered by Us.

9.5. You understand and acknowledge that any material obtained by You or Your permitted assigns in relation to Our Service shall be entirely at Your risk. You are solely responsible for any damage to Your devices or loss of data that results from the download of such material.

9.6. In addition to the above, You further agree and undertake not to:

  9.6.1. Violate or attempt to violate the integrity or security of the Platform or any content therein;
  9.6.2. Transmit any information on or through the Platform that is disruptive, harmful, or competitive to the services offered by Us;
  9.6.3. Intentionally submit false, inaccurate, incomplete, or misleading information;
  9.6.4. Make unsolicited communications to other users of the Platform;
  9.6.5. Use any automated system (including, without limitation, robots, spiders, avatars, intelligent agents, or similar technologies) to access, navigate, or search the Platform;
  9.6.6. Attempt to decipher, decompile, disassemble, reverse-engineer, or derive any source code or algorithms from any part of the Platforms;
  9.6.7. Copy, duplicate, or reproduce any content or proprietary material available on the Platform without prior written authorization from Us;
  9.6.8. Frame, hotlink, or deep-link to any content on the Platforms without Our express consent;
  9.6.9. Post or share on Our social media channels or otherwise any material that is unlawful, fraudulent, defamatory, libellous, slanderous, harassing, abusive, threatening, obscene, or that infringes upon the rights of any third party, including intellectual property rights, confidentiality, or privacy rights.

10. AUTHORISATION


10.1. You hereby also authorize Us to contact You with offers through e-mails, calls, short messaging services (SMS) or any other mediums for any campaigns, promotional or like activities.

10.2. You hereby agree that such methods of contact as provided herein do not classify as an "unsolicited commercial communication" as per the guidelines of Telecom Regulation Authority of India (“TRAI”). You agree to indemnify Us, along with Our directors and employees against all types of losses and damages incurred by them due to any action taken by TRAI or any other authority due to any erroneous complaint raised by You in this regard.

11. MINORS


11.1. Our Platform is not intended for use by individuals under the age of 18 (eighteen) years (“Minors”) unless such use is permitted and supervised by a parent or legal guardian. By accessing or using the Platform, You represent and warrant that You are at least 18 years of age or are using the Platform under the supervision and with the consent of a parent or legal guardian.

11.2. We do not knowingly collect or solicit personal information directly from Minors without appropriate parental or guardian consent. If We become aware that We have collected Personal Data or Sensitive Personal Data from a Minor without verification of parental consent, We will take steps to delete such information at the earliest.

11.3. If You are a parent or legal guardian and believe that a Minor under Your care has provided personal information to Us without Your consent, You may contact Us at Rathi Legacy, Plot No.19/A, Ground Floor, B Side, Hoodi Main Road, Doddanekundi II Stage, Industrial Area, Bengaluru-560048, and We will take appropriate steps to address the concern.

12. INDEMNITY


12.1. You agree to indemnify and hold Us harmless from:

 12.1.1. any actions, claims, demands, suits, damages, losses, penalties, interest and other charges and expenses (including legal fees and other dispute resolution costs) made by any third party due to or arising out of any violation of the terms of this Privacy Policy;
 12.1.2. any acts or deeds, including for any non-compliance or violation, of any applicable law, rules, regulations on Your part; or
 12.1.3. for fraud committed by You.

13.4. In any event, to the extent permitted under Applicable Law, We may retain one copy of the User Information for legitimate business purposes or for evidence purposes and/or for the establishment, to exercise or defence of legal claims and/or to comply with Applicable Laws.

14. GOVERNING LAW AND DISPUTE RESOLUTION


14.1. This Privacy Policy shall be governed by and construed in accordance with the laws of India and subject to the provisions of arbitration set out herein, the courts at Bengaluru, India shall have exclusive jurisdiction in relation to any Dispute (defined below) arising out of or in connection with this Privacy Policy.

14.2. Any adverse action, dispute or difference arising under or relating to this Privacy Policy (“Dispute”) shall at the first instance be resolved through good faith negotiations between the parties hereto, which negotiations shall begin promptly, within 15 (fifteen) days after a party has delivered to the other party a written request for such negotiations. If the parties are unable to resolve the Dispute in question within 15 (fifteen) days of the commencement of such negotiations, the Dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time and rules prescribed thereunder. When any Dispute is under arbitration, except for the matters under dispute, We and You shall continue to exercise the remaining respective rights and fulfil the remaining respective obligations under this Privacy Policy.

14.3. The arbitration shall be conducted by a sole arbitrator appointed by Us and the seat and venue of arbitration shall be in Bengaluru, India.

14.4. The language of the arbitration proceedings and of all written decisions and correspondence relating to the arbitration shall be English.

15. UNDERTAKING


15.1. You hereby undertake as follows:


 15.1.1. You agree that You can enter into a legally binding contract as stipulated under the Indian Contract Act, 1872.
 15.1.2. You expressly undertake to provide to Us, where applicable, information which is true, accurate and valid, and acknowledge that any default or deficiency would inter alia render the provision of the Services by Us, inapplicable.
 15.1.3. You shall be responsible for ensuring compliance with the terms and any of Our other rules. If You do not agree with any part of such terms, You must not avail of any of the Services.

16. FORCE MAJEURE


16.1. We shall not be liable for delays, injuries or inabilities in performance or non-performance in whole or in part of Our obligations mentioned under this Privacy Policy due to any causes that are not due to Our acts or omissions and are beyond Our reasonable control (“Force Majeure”), such as acts of God, pandemics, fire, strikes, pandemic and its fallout, cyber-attacks, embargo, acts of government, acts of terrorism or other similar causes.


16.2. You agree and acknowledge that in such Force Majeure circumstances We may be unable to honour Our obligations under this Privacy Policy.

17. LOG FILES

17.1. We follow a standard procedure of using log files. These files log visitors when they visit Our Platforms. All hosting companies do this and a part of hosting services' analytics. The information collected by log files includes internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking Users' movement on the Platforms, and gathering demographic information.

18. COOKIES AND WEB BEACONS

18.1. Like any other Platforms, We use 'cookies'. Cookies are small files that reside on Your computer's hard drive or device and generally contain an anonymous unique identifier and are accessible by the Platforms that placed them there and not any other sites (“Cookies”).


18.2. These cookies are used to store information including visitors' preferences, and the pages on the Platforms that the visitor accessed or visited. The information is used to optimize the Users' experience by customizing Our web page content based on visitors' browser type and/or other information.


18.3. You may refuse to accept Cookies by activating the setting on Your browser which allows You to refuse the setting of Cookies. However, if You select this setting You may be unable to access certain parts of Our Platforms. 20. CONSENT TO TRANSFER

We are operating in India. If You are located outside of India, please be aware that information We collect will be transferred to and processed as per the laws governing such activity in India. By using the Our Platforms or the Services, or providing Us with any information, You consent to this transfer, processing and storage of Your information in India.

21. ASSIGNMENT

This Privacy Policy shall not be assignable by You without obtaining Our prior written consent. We may assign this Privacy Policy at Our sole discretion without having to issue any notice to You.

22. WAIVER

No failure or delay in exercising any right, power or remedy, by Us under this Privacy Policy shall operate as a waiver thereof.
